Section 4.35 - Effect of Reconsideration(1) If the Commissioner denies a request for reconsideration, the denial shall be final and is not subject to appeal under any provision of M.G.L. c. 151A.(2) If the Commissioner allows a request for reconsideration or reconsiders a decision on his/her own motion, he/she shall reopen the original hearing giving notice to all parties to the original hearing. The reopened hearing shall be conducted in accordance with the procedures prescribed by M.G.L. c. 151A, § 12 or M.G.L. c. 151A, § 39(b), whichever is applicable.(3) If the Commissioner reopens the original hearing, benefits shall be paid or denied in accordance with the original decision until such time as a new decision is issued.
