Section 3.08 - Effect of a Permit(1) Issuance of a permit under 314 CMR 3.00 and 2.00 shall be deemed to allow, to the extent specified in the permit and 314 CMR 3.08, the permittee to discharge pollutants to waters of the Commonwealth, to construct, install, modify, operate and maintain an outlet for such discharge, together with any treatment works required to meet effluent limitations specified in the permit for such discharge in accordance with plans and specifications approved in writing by the Department.(2) Except for any toxic effluent standards and prohibitions imposed under 33 U.S.C. 1251 § 307, compliance with a permit during its term constitutes compliance, for purposes of enforcement, with 33 U.S.C. 1251 §§ 301, 302, 306, 307, 318, 403, and 405.
