Section 40.0857 - Detailed Evaluation of Remedial Action Alternatives(1) Except as provided in 310 CMR 40.0857(2), a detailed evaluation of the remedial action alternatives identified by the initial screening described in 310 CMR 40.0856 shall be conducted to provide the basis for the selection of the remedial action alternative. The detailed evaluation shall evaluate and compare different remedial alternatives using the criteria described in 310 CMR 40.0858.(2) A detailed evaluation is not required in those cases where a remedial action alternative identified during the initial screening:(a) is proven to be effective in remediating the types of oil and hazardous material present at the disposal site, based upon experience gained at other disposal sites with similar site and contaminant conditions;(b) results in the reuse, recycling, destruction, detoxification, treatment or any combination thereof of the oil and hazardous material present at the disposal site;(c) can be implemented in a manner that will not pose a significant risk of harm to health, safety, public welfare or the environment, as described in 310 CMR 40.0900; and(d) is likely to result in the reduction and/or control of oil and/or hazardous material at the disposal site to a degree and in a manner such that the requirements of a Permanent Solution as set forth in 310 CMR 40.1000 will be met.Amended by Mass Register Issue 1503, eff. 3/1/2024.Amended by Mass Register Issue S1516, eff. 3/1/2024.
