Section 30.691 - Applicability310 CMR 30.691 through 30.699, cited collectively as 310 CMR 30.690, prescribe requirements which apply to owners and operators of facilities that use tanks to treat or store hazardous waste, except:
(1) Tank systems that are used to store or treat hazardous waste which contains no free liquids and are situated inside a building with an impermeable floor are exempted from the requirements in 310 CMR 30.694. To demonstrate the absence or presence of free liquids in the stored/treated waste, EPA method 9095B (Paint Filter Liquids Test) as specified in Test Methods for Evaluating Solid Waste, physical/Chemical Methods, EPA Publication SW-846, as incorporated by reference at 310 CMR 30.012 shall be used.(2) Tank systems, including sumps, that serve as part of a secondary containment system to collect or contain releases of hazardous waste are exempted from the requirements of 310 CMR 30.694.Amended by Mass Register Issue 1278, eff. 1/16/2015.
