Section 30.669 - Point of Compliance(1) In the facility's license, the Department shall specify points of compliance at which the requirements of 310 CMR 30.665: Groundwater Protection Standard shall apply and at which monitoring shall be conducted. A point of compliance is a vertical surface which is located at the hydraulically downgradient limit of the waste management area and which extends down into the uppermost aquifer underlying the regulated unit(s).(2) The waste management area is the limit projected in the horizontal plane of the area on which hazardous waste will be placed during the active life of the regulated unit(s). (a) The waste management area includes, without limitation, horizontal space taken up by any liner, dike, or other barrier designed to contain waste in a regulated unit.(b) If the facility contains more than one regulated unit, the waste management area is described by the boundary circumscribing all the regulated units.(3) Monitoring wells installed at points of compliance shall be designed and operated in a manner that will provide an early warning system to alert the owner or operator of the migration of hazardous constituents from a regulated unit to the groundwater in the uppermost aquifer. In the license, the Department may require additional downgradient monitoring wells beyond those points of compliance specified pursuant to 310 CMR 30.669(1). The re-quirements of 310 CMR 30.665 (Groundwater Protection Standard) shall apply to such additional wells.
