Section 30.618 - Stand-by Surface Impoundments - Waiver From Groundwater Monitoring Requirements(1) On a case-by-case basis, the Department may waive all or part of 310 CMR 30.660: Groundwater Protection for surface impoundments that are designed and operated solely for the containment of hazardous waste in the event of an emergency at the facility (e.g., equipment failure or overflows). If such a waiver is granted, the owner or operator shall: (a) Immediately notify the Department by the quickest available means following an emergency which requires that the impoundment be utilized, and follows this up with a written notification within seven days; and(b) Remove all waste from the impoundment as expeditiously as practicable and in a manner and time period approved by the Department.(2) If the owner or operator fails to comply with 310 CMR 30.618(1)(a) or (b), the Department may require that the owner or operator comply with 310 CMR 30.660: Groundwater Protection.(3) Nothing in 310 CMR 30.618 relieves the owner or operator from the responsibility to comply with any other provision of 310 CMR 30.610.
