Section 30.587 - Completion and Certification of Closure(1) Within 60 days of completion of closure of each hazardous waste surface impoundment, waste pile, land treatment unit, and landfill unit, within 60 days of completion of closure of any other hazardous waste management unit, and within 60 days of completion of final closure of the facility, the owner or operator shall submit to the Department, either by hand-delivery or by certified mail, a certification signed by both the owner or operator and by an independent Massachusetts registered professional engineer that: (a) the hazardous waste management unit or facility, as applicable, has been closed in compliance with the requirements of 310 CMR 30.000 and of the approved closure plan, and(b) the survey plat required by 310 CMR 30.586 has been recorded in the appropriate Registry of Deeds or, if the land in question is registered land, in the registry section of the land court for the district wherein the land lies, and copies of the plat have been submitted to the Department and to the Board of Health of the city or town wherein the land lies, in compliance with 310 CMR 30.586.(2) Until the Department, pursuant to 310 CMR 30.904(8), notifies the owner or operator in writing that he is no longer required to maintain financial assurance for closure of the facility, the owner or owner and the independent Massachusetts registered professional engineer who signed the certification required pursuant to 310 CMR 30.587(1) shall each promptly submit to the Department on request any documentation supporting said certification.(3) Closure shall not be considered complete until the Department has notified the owner or operator in writing that he is no longer required to maintain financial assurance for the closure of the facility pursuant to 310 CMR 30.587(2).
