Section 30.406 - Recordkeeping(1) A transporter of hazardous waste shall keep a copy of the manifest signed by the generator, by that transporter, and by the next designated transporter or the owner or operator of the designated facility, for a period of three years from the date the hazardous waste was accepted by the initial transporter.(2) For shipments delivered to the designated facility by water in bulk shipment, each bulk shipment water transporter shall keep a copy of the shipping paper containing all the information required for a period of three years from the date the hazardous waste was accepted by the initial transporter.(3) For shipments of hazardous waste by rail within the United States: (a) The initial rail transporter shall keep a copy of the manifest and shipping paper containing all the information required for a period of three years from the date the hazardous waste was accepted by the initial transporter; and(b) The final rail transporter shall keep a copy of the manifest, or the shipping paper in lieu of the manifest, for a period of three years from the date the hazardous waste was accepted by the initial transporter.(4) The periods prescribed in 310 CMR 30.406 for keeping records shall be extended automatically for the duration of any unresolved enforcement action regarding the activity in question, or as ordered by the Department.Amended by Mass Register Issue 1404, eff. 11/15/2019.Amended by Mass Register Issue 1406, eff. 11/15/2019.Amended by Mass Register Issue 1522, eff. 5/24/2024.
