Section 15.413 - Conditioning of Variances(1) The Local Approving Authority or the Department may issue variances subject to such conditions, including, but not limited to, monitoring and reporting requirements, deed recordation requirements, financial assurances or other qualifications on the use of the system, as it deems necessary to protect public health, safety, welfare and the environment. Any conditions shall be expressed in writing in allowing the variance.(2) Any denial of a variance by the Local Approving Authority or the Department may direct the applicant to upgrade an existing system consistent with the requirements and standards of 310 CMR 15.404 and 15.405. Failure to do so may be the subject of enforcement action by the Local Approving Authority or the Department.
