Section 15.006 - Facilities with a Design Flow of 10,000 gpd or Greater but Less than 15,000 gpd(1) It shall be the duty of each owner or operator of systems with a design flow of 10,000 gpd or greater to ascertain the actual design flow of their system or systems.(2) The Department may require the issuance of a groundwater discharge permit pursuant to 314 CMR 5.00: Ground Water Discharge Permit Program and the installation of technology capable of discharging effluent which meets groundwater standards pursuant to 314 CMR 5.00: Ground Water Discharge Permit Program for any system with design flow of 10,000 gpd or greater but less than 15,000 gpd unless the Department determines after consideration of the factors set forth in 310 CMR 15.304(3) that this requirement would be manifestly unjust, considering all the relevant facts and circumstances of the individual case, and the owner or operator has established that a level of environmental protection that is at least equivalent to that provided by 314 CMR 5.00: Ground Water Discharge Permit Program can be achieved without strict application of 310 CMR 15.006.(3) There shall be no increased flow to an existing system which results in a design flow of 10,000 gpd or greater except in accordance with a variance issued by the Department pursuant to 310 CMR 15.414.
