Section 135.07 - Penalties(1) A violation of 211 CMR 135.00 or M.G.L. c. 175, §113X by an insurance company, producer, third party biller, adjuster or third party administrator for the insurer, shall be punishable by a fine of not less than $1,000 nor more than $5,000 for each violation by each person or entity.(2) Any violation of 211 CMR 135.00 or M.G.L. c. 175, § 113X shall also constitute an unfair method of competition or an unfair or deceptive act or practice in the business of insurance under M.G.L. c. 176D.(3) The commissioner shall administer and enforce the provisions of 211 CMR 135.00 and M.G.L. c. 175, § 113X. If upon complaint, examination or other evidence exhibited to the Commissioner, the Commissioner is of the opinion that any provision of 211 CMR 135.00 has been violated, the Commissioner shall forthwith report the facts to the attorney general or to the proper district attorney.
