Section 610.046 - Notification of Hearing(A) The time, date, and place of the hearing will be arranged so that the hearing is accessible to the appellant. Advance written notice will be mailed by BOH to all parties involved at least ten days prior to the hearing date in order to permit adequate preparation of the case. However, the appellant may request less advance notice to expedite the scheduling of the hearing.(B) The notice will contain the following: (1) the date, time, and location of the hearing;(2) the address and telephone number for BOH to allow for notification if a party cannot attend the scheduled hearing and needs to submit a request for rescheduling in accordance with 130 CMR 610.048;(3) an explanation of the MassHealth agency's hearing procedures, including the appellant's right to representation at the appellant's expense;(4) a statement that the appellant or appeal representative may examine the case file (or resident record, as applicable) before the hearing; and(5) a statement to the appellant indicating that the MassHealth agency will dismiss the hearing request if the appellant or his or her appeal representative fails to appear for the hearing without good cause.Amended by Mass Register Issue 1397, eff. 8/9/2019.
