Section 9.11 - Administrative Review

An administrative review shall be conducted by the regional director or designee for all complaints referred pursuant to 115 CMR 9.05(2) and the results documented in an administrative review report which will form the basis for the development of a resolution letter by the CRT.

(1)Administrative Review. The regional director or designee may conduct interviews and review documents, including but not limited to, incident reports, restraint reports, and medical reports related to the incident, condition or occurrence reported in the complaint and shall prepare an administrative review report.
(2)Administrative Review Report. After conducting the review, the regional director or his or her designee shall issue a report of his or her findings and provide the report to the CRT coordinator within 15 days.
(3)Request for Extension. The regional director or designee may submit a request for an extension of a time limit set forth in 115 CMR 9.00 to the deputy commissioner upon a showing of necessity and that the delay will not pose a threat to the safety or security of the individual involved. If approved, the regional director or designee shall send a notice of extension to the parties.
