If the senior investigator concludes at any time during the course of the investigation that immediate action is necessary to protect the safety or welfare of an individual involved in the complaint, he or she shall immediately communicate to the regional director or designee, orally and in writing, the nature of the allegations, and the identity of the alleged victim and the alleged abuser (if applicable).
(1) The regional director or designee shall notify the provider who shall be responsible for taking immediate action;(2) A provider notified of a complaint alleging intentional physical injury of an individual, including any sexual activity between an individual and an employee or volunteer of a provider shall immediately remove the employee or volunteer from all direct contact responsibilities pending resolution or investigation of the complaint.Amended by Mass Register Issue 1336, eff. 4/7/2017.
