(1) All papers which must be submitted to the hearing office will be considered to be filed as follows: (a) Papers hand delivered during business hours shall be considered filed that day;(b) Papers hand delivered after business hours or on weekends or holidays shall be considered filed the next business day;(c) Papers which are mailed shall be considered filed on the date postmarked.(2) Any written notices or other papers mailed by the Department Hearing Office shall be considered to be received five days after mailing.(3) Time periods shall be computed starting with the day after the act which initiates the time period. If the final day falls on a non-business day, the deadline is extended to the next business day.(4) Any time limit in 110 CMR 10.00 may be extended if there is good cause for doing so and the extension is not inconsistent with state or federal law or regulation. Requests for extension of time must be in writing and must be filed before the deadline expires. Filing a request shall automatically extend the deadline until the Hearing Office rules on the request.
