Section 367.175 - Denial or Dismissal of Request for HearingThe Division of Hearings shall deny or dismiss a request for a hearing when:
(A) the request is not received within the time frame provided in 106 CMR 367.100;(B) the request is withdrawn either orally or in writing by the household or its representative. If an appellant orally withdraws an appeal, the Department will follow the procedures provided in 7 CFR § 273.15(j)(2); or(C) the household or its representative fails, without good cause, to appear at the scheduled hearing.Amended by Mass Register Issue 1329, eff. 12/30/2016.
