Section 364.860 - Notice of Adverse ActionThe Notice of Adverse Action shall be sent to all households prior to terminating or reducing benefits, except as provided in 106 CMR 366.210: Changes not Requiring Advance Notice to ensure timely and adequate advance notice of the proposed action. The Notice of Adverse Action shall include the following information:
(B) The reason for the proposed action;(C) The household's right to request a fair hearing;(D) The telephone number and, if possible, the name of the individual to contact for additional information;(E) The availability of continued benefits and the date by which a hearing request must be filed to ensure such continuation;(F) The liability of the household for any overissuance received while awaiting a fair hearing, if the hearing official's decision is adverse to the household; and(G) If there is an individual or organization that provides free legal representation, the notice shall also advise the household of the availability of the service.Amended by Mass Register Issue 1330, eff. 1/13/2017.Amended by Mass Register Issue 1472, eff. 6/24/2022.
