Pursuant to M.G.L. c. 111, § 127A, any operator who shall violate any provision of 105 CMR 440.00, or who shall fail to comply with any order issued pursuant thereto, shall, upon conviction, be fined not less than $10, no more than $500. Each day's failure to comply with an order shall constitute a separate violation. (See105 CMR 440.23(6) ) .
