Section 410.840 - Final Decision after Hearing; Failure to Comply with Final OrderThe board of health shall notify the petitioner and all affected persons in writing of its decision to sustain, modify, or withdraw the order within five calendar days after the conclusion of the hearing.
(A) If the board of health sustains or modifies the order, it shall be carried out within the time period allotted in the original order or in the modification.(B) If after a hearing the order has been sustained in whole or part, each day's failure to comply with the order as issued or modified shall constitute an additional offense.Amended by Mass Register Issue 1495, eff. 5/12/2023.Amended by Mass Register Issue 1497, eff. 5/12/2023.
