Section 180.004 - Waiver of Requirements Imposed on Laboratories(A) The Commissioner may waive the applicability to a particular laboratory of one or more of the requirements imposed on that laboratory by 105 CMR 180.000 if the Commissioner finds that: (1) compliance would cause undue hardship to the laboratory; and(2) the laboratory is in substantial compliance with the spirit of the requirement; and(3) the laboratory's non-compliance does not adversely affect the quality of the laboratory's test results.(B) The laboratory shall provide to the Commissioner or his/her designee written documentation supporting its request for a waiver.
