Section 209.335 - Penalties(a) Any individual who violates §209.331(c) or §209.333(a) may be permanently disqualified from performing the safety-sensitive functions described in §209.303. Any individual who willfully violates §209.331(c) or §209.333(a) may also be assessed a civil penalty of at least $1,000 and not more than $5,000 per violation.(b) Any railroad that violates §209.331 (a) or (b) or §209.333(b) may be assessed a civil penalty of at least $5,000 and not more than $11,000 per violation.(c) Each day a violation continues shall constitute a separate offense.54 FR 42907, 10/18/1989, as amended at 63 FR 11619, 3/10/1998
