Section 233.23 - When assistance shall be paid under retrospective budgeting(a) A State which uses retrospective budgeting shall specify in its plan that it will make assistance payments within the following time limits to recipients who file a completed report on time, and to those who are not required to file a report. A State shall choose one of two time periods for making assistance payments. The State plan shall provide that payment must be made:(1) Within 25 days from the close of the budget month; or(2) Between 25 and 45 days from the close of the budget month.(b)(1) Where a State makes payments between 25 and 45 days from the close of the budget month, the State plan shall provide that the State will make supplemental payments as provided in §233.27.(2) If a State makes payments within 25 days from the close of the budget month, and also makes supplemental payments as provided in §233.27, the State plan shall so specify.(c) In States which issue two checks for each payment month, these time periods apply to the first check.
