Section 30528 - Review of Transfer(a) A ward shall have the right to: (1) Challenge the stated reasons for an administrative transfer, and(2) Have the superintendent consider whether the reason for the transfer is: (A) Being properly applied,(B) Appropriate to his program objectives, or(C) Necessitated by reasons of institutional security.(b) A ward transferred under an emergency situation and without a prior interview shall receive within eight days of the transfer a copy of the case report. The superintendent (or appropriate person in a non-Youth Authority facility) at the receiving institution shall explain to the ward his rights concerning administrative transfers, including the right to use the ward grievance procedure.(c) A ward may request an interview with a staff person to discuss his transfer. The interview shall be held within ten days following notification of such request.(d) If it is determined from the interview that the transfer is inappropriate or improper, the superintendent or appropriate person in a non-Youth Authority facility may: (1) Return the ward to the sending institution, or(2) Make arrangements for a transfer to a more suitable institution or facility.Cal.
