The Executive Director may determine in writing that a particular consultant or new position, although a designated position, is hired to perform a range of duties that is limited in scope and is not required to fully comply with the disclosure requirements in this section. Such written determination shall include a description of the consultant's or new position's duties and, based upon that description, a statement of the extent of disclosure requirements. The Executive Director's determination is a public record and shall be retained for public inspection in the same manner and location as this conflict of interest code. (Gov. Code Sec. 81008.)

Disclosure Categories

Category 1

Designated positions assigned to this category must report:

All business positions and sources of income, including receipt of gifts, loans, and travel payments, from any school, college, or university offering courses or curricula which are approved by the Commission on Teacher Credentialing.

Category 2

Designated positions assigned to this category must report:

All investments, business positions, and sources of income, including receipt of gifts, loans, and travel payments, from sources engaged in providing research work, program development, program auditing, testing and examination or professional consulting work or services of the type utilized by the Commission on Teacher Credentialing.

Category 3

Designated positions assigned to this category must report:

All investments, business positions, and sources of income, including receipt of gifts, loans, and travel payments, from sources that contract to provide goods and services, renders services or sells products or equipment of the type utilized by the Commission on Teacher Credentialing or manufactures, wholesales or distributes such products or equipment.

Category 4

Designated positions assigned to this category must report:

All investments, business positions, and sources of income, including receipt of gifts, loans, and travel payments, from sources that would be beneficially or adversely affected by current pending legislation which amends the education code (those sections regulated by the Agency). Sources include organizations such as nonprofits, unions, and trade associations that represent educators' interests.

Category 5

Designated positions assigned to this category must report:

All investments, business positions and sources of income, including receipt of gifts, loans, and travel payments, from individuals holding professions regulated by the Commission on Teacher Credentialing.

Category 6

A designated position in this category must report investments and business positions in business entities, and sources of income, including receipt of gifts, loans, and travel payments, from information technology sources, including but not limited to, computer hardware or software companies, computer consultant services, training, and data processing firms.
