** Consultants/new positions shall be included in the list of designated positions and shall disclose pursuant to the broadest disclosure category in the code subject to the following limitation:

The Chief Deputy Superintendent may determine in writing that a particular consultant or new position, although a "designated position," is hired to perform a range of duties that is limited in scope and thus is not required to comply with the disclosure requirements described in this section. Such determination shall include a description of the consultant's or new position's duties and, based upon that description, a statement of the extent of disclosure requirements. The Chief Deputy Superintendent's determination is a public record and shall be retained for public inspection in the same manner and location as this conflict-of-interest code. (Gov. Code, § 81008.) Disclosure Categories:

Category I.

Positions designated in this category shall report interests in real property located in California.

Category II.

Positions designated in this category shall report investments, business positions, and sources of income (including receipt of gifts, loans and travel payments) that:

a. Are subject to, or be of the type to be subject to, approval, monitoring, or certification by CDE.

b. Provide, or is likely to provide, goods, leased facilities, equipment, machines, vehicles or services, including consulting or training services, to CDE.

c. Receive, or is likely to receive, grant funding or other money from CDE.

Category III.

Positions designated in this category shall report investments, business positions, and sources of income (including receipt of gifts, loans and travel payments) subject to, or be of the type to be subject to, approval, monitoring, or certification by the employee's division or organizational unit.

Category IV.

Positions designated in this category shall report investments, business positions, and sources of income (including receipt of gifts, loans and travel payments) that provide, or of the type that provide goods, leased facilities, equipment, machines, vehicles or services, including consulting or training services, to the employee's division or organizational unit.

Category V.

Positions designated in this category shall report investments and business positions in business entities and sources of income (including receipt of gifts, loans and travel payments) if the business entity or source is of the type to receive grants or other funding from or through the designated position's division or organizational unit.

Category VI.

Positions designated in this category shall report investments, business positions and sources of income (including receipt of gifts, loans and travel payments) are educational publishers, or vendors of instructional materials that are, or may be, utilized by public schools in California.
