Section 12276 - Review and Approval of Amendments to Tppps Contracts
(a) Requests to review and approve an amendment to a TPPPS contract must be submitted with an application for approval [see Section 12272 (a)(2)(A)] along with an executed copy of the TPPPS contract, the application fee required in Section 12090, and a deposit as required by Title 11, California Code of Regulations, Section 2037. The Bureau may require an additional sum to be deposited to pay the final costs of the review and approval or disapproval of the amendment. Any money received as a deposit in excess of the costs incurred in the review and approval or disapproval of the amendment must be refunded and an itemized accounting must be provided to the TPPPS business licensee or the TPPPS business licensee's designee.
(b) No amendment changing any of the TPPPS contract terms referred to in Section 12270, other than paragraphs (3), (4), and (6) of subsection (b) thereof, may become effective during the term of a TPPPS contract without the prior written approval of the Bureau. If any amendment is made to a TPPPS contract term specified in paragraphs (3), (4), or (6) of subsection (b) of Section 12270, both parties to the TPPPS contract must notify the Bureau in writing of the amendment within 10 days of the execution thereof by the parties to the TPPPS contract.

Filing deadline specified in Government Code section 11349.3(a) extended 60 calendar days pursuant to Executive Order N-40-20.
2. Amendment of subsection (a) filed 10-7-2021 as an emergency; operative 10-7-2021 (Register 2021, No. 41). A Certificate of Compliance must be transmitted to OAL by 4-5-2022 or emergency language will be repealed by operation of law on the following day.
3. Amendment of subsection (a) refiled 4-4-2022 as an emergency; operative 4-4-2022 (Register 2022, No. 14). A Certificate of Compliance must be transmitted to OAL by 7-5-2022 or emergency language will be repealed by operation of law on the following day.
4. Amendment of subsection (a) refiled 7-5-2022 as an emergency; operative 7-5-2022 (Register 2022, No. 27). A Certificate of Compliance must be transmitted to OAL by 10-3-2022 or emergency language will be repealed by operation of law on the following day.
5. Certificate of Compliance as to 7-5-2022 order, including further amendment of subsection (a), transmitted to OAL 7-21-2022 and filed 9-1-2022; amendments effective 9-1-2022 pursuant to Government Code section 11343.4(b)(3) (Register 2022, No. 35).
