Section 10200.10 - Applicant Eligibility Criteria

An Applicant shall be eligible to apply for an award of Program funds under this Program if all of the following conditions are met:

(a) An approved charter has been awarded and is in place and current at the time of Application and throughout the Application review and approval process.

(b) The Charter School is in good standing with its Charter Authorizer and is in compliance with the terms of its charter at the time the Application is submitted. The Authority will rely on information from the Charter Authorizer regarding the Charter School's good standing and compliance with the terms of its charter.

(c) The Charter School is established pursuant to Education Code section 47600 et seq., and also meets the federal definition of Charter School as defined in section 5210(1) of the ESEA as amended by the NCLB of 2001.

1. New section filed 3-21-2022 as an emergency; operative 3-21-2022 (Register 2022, No. 12). A Certificate of Compliance must be transmitted to OAL by 9-19-2022 or emergency language will be repealed by operation of law on the following day.
2. New section refiled 9-21-2022 as an emergency; operative 9-21-2022 (Register 2022, No. 38). A Certificate of Compliance must be transmitted to OAL by 12-20-2022 or emergency language will be repealed by operation of law on the following day.
3. New section refiled 12-19-2022 as an emergency; operative 12-21-2022 (Register 2022, No. 51). A Certificate of Compliance must be transmitted to OAL by 3-21-2023 or emergency language will be repealed by operation of law on the following day.
4. Certificate of Compliance as to 12-19-2022 order transmitted to OAL 3-17-2023 and filed 5-1-2023 (Register 2023, No. 18).
