Section 3835 - Complete, Incomplete, and Valid Applications(a) Upon receipt of an application, it shall be reviewed by the certifying agency to determine if it is complete. If the application is incomplete, the applicant shall be notified in writing no later than 30 days after receipt of the application, of any additional information or action needed.(b) If an application is determined to be incomplete by the certifying agency, an extension of the federal period for certification cannot be obtained, and the federal period for certification will expire before the certifying agency can receive and properly review the missing information, the certifying agency shall deny without prejudice certification for any discharge resulting from the proposed activity unless the applicant in writing withdraws the request for certification.(c) When a complete application is received, the applicant, the federal agency, and EPA shall be notified no later than 30 days after receipt of the application.(d) A request for certification shall be considered valid if and only if a complete application is received by the certifying agency.Cal.
