Section 89244 - Inspection and Evaluation Authority of the Licensing Agency(a) The licensing agency shall have the authority to inspect and evaluate the home as specified in Health and Safety Code sections 1533, 1534, and 1538.(b) The licensing agency shall have the authority to interview any "child" in the home without prior consent. (1) The caregiver shall make provisions for private interviews with any "child."(c) The licensing agency shall have the authority to inspect, audit, and copy records that pertain to a "child" or the home upon demand during normal business hours. Records may be removed if necessary for copying. Removal of records shall be subject to the requirements in Sections 89370, subsection (b) and 89566, subsection (d). (1) The caregiver shall make all records relating to the operation of the foster family home available for review.(d) The licensing agency shall have the authority to observe the physical condition of a "child," including conditions which could indicate abuse, neglect, or inappropriate placement, and to have a licensed medical professional physically examine the "child."(e) The licensing agency shall have the authority to make additional visits to the home in order to determine compliance with applicable laws and regulations.Cal.
