(a) The written needs and services plan shall be updated at least annually and: (1) As frequently as necessary to ensure accuracy and to document determination of a disability.(2) As frequently as determined necessary by the child's authorized representative.(b) If modifications to the plan identify unmet needs the following requirements shall be met: (1) It shall be determined whether the licensee has the ability to meet the needs of the child. (A) If it is determined that the identified needs can be met by the licensee, a written plan to meet the needs shall be developed and maintained in the home.(B) If it is determined that the identified needs cannot be met by the licensee, the licensee shall give notice to the child's authorized representative to remove the child from the home.(c) The licensee shall permit the participation of the child's authorized representative in modification to the needs and services plan.
