(a) The licensing agency shall evaluate and inspect Adult Day Programs pursuant to the authority specified in Health and Safety Code Sections 1526.5, 1533, 1534, and 1538.(b) The licensing agency shall have the authority to interview clients or staff members without prior consent. (1) The licensee shall ensure that provisions are made for private interviews with any clients or any staff members.(c) The licensing agency shall have the authority to inspect, audit, and copy client or facility records upon demand during normal business hours. Records may be removed if necessary for copying. Removal of records shall be subject to the requirements specified in Sections 82066(c) and 82070(d). (1) The licensee shall ensure that provisions are made for the examination of all records relating to the operation of the facility.(d) The licensing agency shall have the authority to observe the physical condition of the client, including conditions which could indicate abuse, neglect, or inappropriate placement, and to have a licensed medical professional physically examine the client.(e) The licensing agency shall have the authority to make any number of other visits to a day program in order to determine compliance with applicable laws and regulations.Cal.
