(a) No person, firm, partnership, association, corporation, receiver, political subdivision of the State or other governmental agency within the State shall establish, operate or maintain a home health agency or hold out, represent or advertise by any means that it operates a home health agency without first obtaining a license from the Department.(b) A subdivision or department of any facility or other agency, such as a hospital, skilled nursing facility or health department may be approved to operate as a home health agency, provided a separate license is obtained. In such facilities or agencies, records shall be maintained in such a manner that activities and expenditures for services provided by the home health agency are separate and identifiable.Cal.
