Section 117200 - [Operative 7/1/2024] General Requirements for Use of One-State Remedies
(a) Subject to the discretion set forth in 45 C.F.R. § 303.7(c)(3) a local child support agency shall establish parentage and/or a child support order using one-state remedies if parentage and support have not been established, and the facts of the case indicate that the requirements for asserting personal jurisdiction over the alleged parent in another state or a foreign country are met.
(b) In cases in which parentage and/or a child support order must be established, and an alleged parent does not reside in California, a local child support agency shall obtain sufficient information to determine whether any basis exists upon which California can assert personal jurisdiction over the alleged parent.
(c) In making the determination described in subsections (a) and (b), the local child support agency shall review the case for any factors as defined in Family Code Section 5700.201 which may give a tribunal personal jurisdiction.
