(a) A written application for elective coverage under Section 710 of the code by a public entity signed by a duly constituted official shall be approved if the director finds that:(1) It is an application for coverage of services performed for the public entity which do not constitute employment except that the public entity may exclude from coverage any of the service set forth in Section 634.5 of the code.(2) The applicant is a "public entity" as that term is defined in Section 605 of the code.(3) It sets forth the name and address of the public entity.(4) It is accompanied by advance payments as required by Section 803 of the code.(b) Sections 701-1, 701-2, and 705-1 of these regulations apply to elections filed pursuant to Section 710 of the code.(c) Notwithstanding Section 705-1 of these regulations, if a public entity is succeeded in whole or in part by another public entity the successor may elect to continue the elective coverage agreement of the predecessor or may elect to terminate the elective coverage agreement of the predecessor. If the successor public entity was, prior to the acquisition of the predecessor, a public entity under an approved elective coverage agreement, the elective coverage agreement of the predecessor shall be continued to the same extent as the elective coverage agreement of the successor. If the successor public entity was, prior to the acquisition of the predecessor, a public entity not under an approved elective coverage agreement, the successor shall meet the requirements of this section if it elects to continue the elective coverage agreement of the predecessor.Cal.
