Section 4060 - Resolution of Unallowable Costs(a) If a sponsor's audit pursuant to PUC section 21686 identifies unallowable costs, the sponsor shall either:(1) Repay the Department for the unallowable costs within 30 days of the date that the sponsor submitted its audit findings to the Department or,(2) Request the Department waive the costs within 30 days of the date that the sponsor submitted its audit findings to the Department. If the sponsor requests a waiver of the costs, but the Department does not waive them, the sponsor shall repay the costs within 30 days' of its receipt of the Department's notice. The State Controller has the authority to withhold other state funds due the sponsor in order to repay the State Aeronautics Account when the sponsor fails to make restitution as required by this regulation.
(b) "Unallowable costs" include funds used for "land acquisition" if the acquired land is not used for the purpose for which funding was authorized within three years of purchase unless the sponsor has a written waiver from the Department.Cal. Code Regs. Tit. 21, § 4060
