Permanent or probationary employees who vacate positions to accept emergency appointments shall have a mandatory right of return to their former position upon the conclusion of the emergency appointment if:
(a) The emergency appointment is under the same appointing power as the position the employee is vacating; or(b) The employee is granted paid or unpaid leave to accept the emergency appointment.Cal. Code Regs. Tit. 2, § 304
