(a) A regional center may enter into a contract for the provision of transportation service in which the rate of payment is based on a cost statement. The regional center may enter into such contracts only with an entity vendored or eligible to be vendored as either:(1) Transportation Companies - Service Code 875, pursuant to Title 17, California Code of Regulations, Section 54342(a)(82); or(2) Transportation Additional Component - Service Code 880, pursuant to Title 17, California Code of Regulations, Section 54342(a)(78).(b) The rate of payment based on a cost statement shall be effective for at least one year. If the term of the contract exceeds one year, the rate shall be effective for the full term of the contract unless amended.(c) When a proposed contract for transportation service is based on a cost statement, the vendor shall submit Form DS2 (7/91), entitled Transportation Cost Statement, to the regional center. Within 30 days after receipt of Form DS2 (7/91) from the vendor, the regional center shall:(1) Review the Form DS2 (7/91) for compliance with Sections 58551, 58552, 58553 and 58555 of these regulations; and(2) Calculate a proposed rate of payment pursuant to Section 58554, based on the information contained on the Form DS2 (7/91).Cal.
