The diversion evaluation committee may deny an applicant acceptance to the impaired physician program for any of the following reasons:
(a) The applicant does not meet the requirements set forth in Section 1660.(b) The applicant, after formal investigation, has been subject to disciplinary action by any state medical licensing authority.(c) Formal complaints or information have been received by the board which, after investigation, indicate that the applicant may have violated a provision of the Medical Practice Act(Division 2, Chapter 5 of the Code, starting with Section 2000, excluding Section 2239).(d) The committee determines that the applicant will not substantially benefit from participation in the program or that the applicant's participation in the program creates too great a risk to the public health, safety or welfare.Cal.
