Section 3769.3 - Participation in the Reentry Court Program
(a) Supervised persons who meet the eligibility criteria provided in section 3769.1 and who are not otherwise excluded as provided for in section 3769.2 may participate in the Reentry Court Program (RCP) if one of the following referrals is made:
(1) The RCP judge may refer a supervised person who is under the dual jurisdiction of the department and local probation, or who is currently on parole and facing new criminal charges that may result in a new conviction and subsequent return to prison.
(2) A Deputy Commissioner may refer a supervised person who commits a violation of parole to the RCP as a remedial sanction. The Parole Violation Decision Making Instrument shall be utilized in making a determination whether to refer the supervised person, pursuant to the provisions of sections 3768 through 3768.3.
(3) Parole Agents may refer directly to the RCP a supervised person who commits a violation of parole which is not subject to mandatory referral to the Board of Parole Hearings pursuant to section 2616. A supervised person referred under this subsection shall:
(A) Waive their right to a revocation hearing by signing a CDCR Form 1420 (Rev. 07/24), Placement Acknowledgement Waiver, which is incorporated by reference.
(B) Sign the CDCR Form 1515-RCP (07/24), Reentry Court Program Special Conditions of Parole, which is incorporated by reference.

1. New section filed 4-15-2011 as an emergency; operative 4-15-2011 (Register 2011, No. 15). Pursuant to Penal Code section 5058.3, a Certificate of Compliance must be transmitted to OAL by 9-22-2011 or emergency language will be repealed by operation of law on the following day.

3. Change without regulatory effect amending section filed 7-1-2024 pursuant to section 100, title 1, California Code of Regulations (Register 2024, No. 27).
