Section 3691.3 - Determination of Jurisdiction(a) The Chair of the Board, or the Chair's designee (Board Member), shall determine whether the appeal is within the jurisdiction of the Board for purposes of hearing the appeal. Where the Chair or the Chair's designee finds that the Division provided comments to the lead agency pursuant to Public Resources Code section 2773.4, the Chair or the Chair's designee shall grant a hearing on the appeal.(b) The Board shall notify the Division and the lead agency of the determination of jurisdiction by the Chair or the Chair's designee.Cal.
