Section 3805 - Review by the Division of Mine Reclamation

Pursuant to Section 2773.4, Public Resources Code, the lead agency shall submit a copy of the proposed Financial Assurance and the Calculation of Financial Assurance Amount submitted by the operator pursuant to Section 3804 to the supervisor of the Division of Mine Reclamation for review. With this submittal the lead agency shall include the information and documentation relied upon in calculating the amount of the proposed Financial Assurance and indicate to the supervisor that the Financial Assurance Amount is adequate for the lead agency or the Division of Mine Reclamation to conduct and complete reclamation on the mined lands in accordance with the approved reclamation plan. The supervisor shall have 45 days, upon receipt, to prepare written comments regarding the proposed Financial Assurance, if he/she so chooses.
