Section 3803 - Financial Assurance Mechanisms

Financial Assurance Mechanisms may take the form of any one or a combination of the following:

(a) For non-governmental entity operators:

(1) Surety bonds;

(2) Irrevocable letters of credit; and

(3) Trust funds;

(b) For governmental entity operators:

(1) Surety bonds;

(2) Irrevocable letters of credit;

(3) Trust funds;

(4) Pledges of Revenue; or

(5) Budget Set Aside.

1. New section filed 2-23-94 as an emergency; operative 2-23-94 (Register 94, No. 8). A Certificate of Compliance must be transmitted to OAL by 6-23-94 or emergency language will be repealed by operation of law on the following day.
2. Certificate of Compliance as to 2-23-94 order transmitted to OAL 6-22-94 and filed 8-3-94 (Register 94, No. 31).
3. Amendment of first paragraph and NOTE filed 5-24-2018; operative 7-1-2018 (Register 2018, No. 21).
