Section 29302 - Investigations and Notices
(a) The Office may investigate the following:
(1) Whether an approved Wildfire Mitigation Plan was followed;
(2) Whether failure to follow the Wildfire Mitigation Plan contributed to an ignition;
(3) Whether the regulated entity is noncompliant with its duties and responsibilities or has otherwise committed violations of any laws, regulations, or guidelines within the authority of the Office; and
(4) Other related investigations within the authority of the Office, as requested by the Director.
(b) Based on the findings of any investigation, the Office may issue any of the following:
(1) Notice of defect, identifying a deficiency, error, or condition increasing the risk of ignition posed by electrical lines and equipment requiring correction; or
(2) Notice of violation, identifying non-compliance with an approved Wildfire Mitigation Plan or any law, regulation, or guideline within the authority of the Office.

1. New section filed 9-13-2021 as an emergency; operative 9-13-2021 (Register 2021, No. 38). A Certificate of Compliance must be transmitted to OAL by 3-14-2022 or emergency language will be repealed by operation of law on the following day.
2. New section refiled 3-10-2022 as an emergency; operative 3-15-2022 (Register 2022, No. 10). A Certificate of Compliance must be transmitted to OAL by 6-13-2022 or emergency language will be repealed by operation of law on the following day.
3. New section refiled 6-6-2022 as an emergency; operative 6-14-2022 (Register 2022, No. 23). A Certificate of Compliance must be transmitted to OAL by 9-12-2022 or emergency language will be repealed by operation of law on the following day.
4. Certificate of Compliance as to 6-6-2022 order, including amendment of section heading, section and NOTE, transmitted to OAL 7-26-2022 and filed 9-7-2022; amendments effective 9-12-2022 pursuant to Government Code section 11343.4(b)(3) (Register 2022, No. 36).
