(a) An insurer shall submit all non-standard policy forms, endorsement forms, or ancillary agreements to the Insurance Commissioner through the rating organization prior to their use as part of a workers' compensation policy. A non-standard policy form, endorsement form, or ancillary agreement, other than a limiting and restricting endorsement or a customized limiting and restricting endorsement, may be used by an insurer if the Insurance Commissioner does not take any action on the form within 30 days after the date of submission to the Insurance Commissioner.(b) An insurer shall not use policy forms, endorsement forms, or ancillary agreements unless submitted to and approved by the Insurance Commissioner, except as provided in Subdivision (a).Cal.
