2. IMPORTED FIRE ANT QUARANTINE Quarantined Pests
The quarantined pest is the Imported Fire Ant. This can be the Red Imported Fire Ant Solenopsis invicta(Buren) or the Black Imported Fire Ant Solenopsis richteri (Forel) or any hybrid of the two.
Quarantined Areas
(a) The department hereby adopts by reference as quarantined areas those counties in Arkansas, or portions there of, listed as regulated areas in the most current federal imported fire ant quarantine as adopted by the United States Department of Agriculture, and found at 7 Code of Federal Regulations § 301.81 -3. A copy of the regulation may be obtained at the Arkansas State Plant Board,(b) In addition to the areas described in subsection(a) of this section, Pulaski, Saline, Garland, Jefferson, Grant, Hot Spring, Pike Howard, Sevier, Clark, Dallas, Cleveland, Lincoln, Desha, Drew, Bradley, Calhoun, Quachita, Nevada, Hempstead, Little River, Miller, LaFayette, Columbia, Union, Ashley and Chicot counties in Arkansas are quarantined areas. Quarantined Articles
(a) Quarantined articles are: (1) the imported fire ant in any living stage of development;(3) plants with roots with soil attached;(5) baled hay and baled straw stored in direct contact with the ground;(6) Any articles that are regulated under the most current federal imported fire quarantine as adopted by the Untied States Department of Agriculture of the 7 Code of Federal Regulations 301.81-2. A copy of the regulation maybe obtained at the Arkansas State Plant Board.(b) Any other products, articles, or means of conveyance of any character whatsoever, not covered by subsection (a) of this section, are quarantined articles when it is determined that they present a hazard of spread of imported fire ants and the person in possession thereof has been so notified.Restrictions
(a) General. Quarantined articles from the quarantined area are prohibited entry into or through the free areas of Arkansas, except as provided in subsections (b) and (c) of this section.(b) Exemptions. The following quarantined articles are exempt from permit requirements: (1) baled hay and baled straw stored in a manner in which they are not in direct contact with the ground.(2) other exemptions may be granted upon department review and issuance of written exemption.209.02.01 Ark.
