Physical Plant
As used in this rule, "unencumbered space" means:

The facility shall conform to all applicable zoning ordinances or, through legal means, is attempting to comply with or change such laws, codes, or zoning ordinances.
Exits in the facility shall be in compliance with state or local fire authorities or the authority having jurisdiction of the facility.

Facility Services
It is the policy of the Division of Youth Services (DYS) that when medically indicated, chronic, convalescent, or medical preventive care will be provided to all youths placed in DYS custody and housed in either a DYS-operated or contracted facility.
As used in this section, "emergency health care" means health treatment, services, or accommodations provided to an injured or ill person for the sudden onset of a medical condition or illness.
It is the policy of the Division of Youth Services (DYS) to have active provisions in place for the as-needed delivery of both emergency and 24-hour health care to youth who are:
It is the policy of the Division of Youth Services (DYS) that coordination and delivery of health care services to juveniles in the custody of the DYS and placed in DYS facilities will be performed by qualified healthcare trained personnel, as deemed by appropriate licensing authority.
It is the policy of the Division of Youth Services (DYS) that active monitoring against the occurrence of alcohol or drug abuse by youth in DYS custody shall occur at all DYS-operated or contract facilities in which DYS juveniles are housed.
As used in this section, "prosthesis" means a device either external or implanted that substitutes for or supplements a missing or defective part of the body.
It is the policy of the Division of Youth Services (DYS) that either a medical or dental prosthesis shall be made available to youth placed in secure custody of DYS who have been determined by a qualified or responsible physician to be in need of such medical or dental prosthesis.
It is the policy of the Division of Youth Services (DYS) that delivery of all mental health services to juveniles placed in the custody of DYS shall be provided by qualified professionals who meet the educational, licensure, and certification criteria specified for their professional discipline.
As used in this section, "health authority" means an individual, agency, or organization qualified to provide medical and healthcare services.
As used in this section, "infectious disease" means disorders causes by germs or organisms such as bacteria, viruses, fungi, or parasites.

The Division of Youth Services (DYS) is committed to maintaining complete and accurate health records on all youth in its physical custody.
When a youth discharges from a facility or program, a complete and accurate copy of the health record shall be sent in hard copy or electronic format to the DYS Records Unit within five (5) business days.
Juvenile Services
As used in this section, "marking period" means each quarter as designated on the school calendar.

It is the policy of the Division of Youth Services (DYS) that the administrative release of youth from DYS custody shall occur in a manner that reflects fairness in the application of DYS release authority or discretion, in accordance with Ark. Code Ann. § 9-28-210 and provisions of the American Correctional Association.
Any denial of a request for religious participation or accommodation may be appealed under the DYS Grievance Policy.
As used in this section, "revocation" means the cancelling of a privilege or status that was previously granted by a local or state authority.
