Rule 007.15.00-005 - Rules and Regulations for Fees for Influenza Vaccinations within the State of Arkansas
SECTION I AUTHORITY

The following Rules and Regulations Pertaining to fees for flu vaccinations are duly adopted and promulgated by the Arkansas Board of Hearth pursuant to the authority expressly conferred by the laws of the State of Arkansas including, without limitation, Act 387 of 1989 (Ark. Code Ann. § 20-7-Ug)

SECTION II. PURPOSE

These Rules and Regulations are established to permit the Arkansas Department 0f Health to establish a fee for providing and administering influenza vaccine to the public.

SECTION III COMMUNICATIONS

All communications concerning these regulations should be addressed to the Arkansas Department of Health, Division of Immunization and Communicable Disease, 4815 West Markup Lhtlg Rock, Arkansas, 72205.

SECTION IV. DEFINITIONS
A. Fee: The charge authorized to recover part or all of the costs for priding and administering flu vaccine.
BFlu Vaccine: Injectable vaccines containing antigens representing the current circulating influenza strains.
SECTION V. GENERAL REQUIREMENTS

Fee for Influenza Vaccine. The Arkansas Department of Health Division of Immunization and Communicable Disease is authorized to charge a fee not to exceed the usual, reasonable and customary reimbursement amount to recover cost for providing and administering influenza vaccine to the public

SECTION VI. SEVERABILITY

If any provision of these Rules and Regulations, or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of these Rules and Regulations which can give effect without the invalid provisions or applications, and to this end the provisions hereto are declared to be severable.

SECTION VIIREPEALING CLAUSE

All Regulations and parts of Regulations in conflict herewith are hereby repealed]

CERTIFICATION

This will certify that the foregoing Rules and Regulations Pertaining to General Sanitation were adopted by the Arkansas Board of Health at a regular session of said Board held in Little Rock, Arkansas, on the 16 day of OCTOBER. 2000.
