Section R7-2-1007 - Delegation of Procurement AuthorityA. The governing board may, in a public meeting held in conformity with A.R.S. Title 38, Chapter 3, Article 3.1, delegate procurement authority to a designee. Any delegation shall be accomplished by adopting a governing board policy for this purpose. 1. Delegated procurement authority may include, but is not limited to the following: a. Authority to make determinations required by Articles 10 and 11;b. Authority to award contracts;c. Authority to make sole source and emergency procurements; andd. Authority to approve change orders and contract modifications.2. Delegated activities and functions shall be adequately separated among individuals so that one individual does not have complete authority over an entire procurement.B. Any delegation shall specify: 1. The title of the school district employee or employees to whom authority is delegated;2. The activity or function authorized;3. Any limits or restrictions on the exercise of the delegated authority, including the maximum cost of any procurement;4. Whether the authority may be further delegated;5. The duration of the delegation; and6. The conditions and procedures for revocation and modification of the delegation.C. No person delegated such authority may participate in any aspect of a specific procurement if the person would receive any benefit directly or indirectly from a contract for such procurement. Violation of this prohibition may result in termination or other disciplinary action.D. Delegation of procurement authority does not abrogate the responsibility of the governing board to ensure compliance with Articles 10 and 11 notwithstanding the fact that school district personnel were authorized to make procurement decisions.Ariz.
