Section R6-8-112 - Subpoena of Witnesses and DocumentsThe hearing officer may subpoena any witnesses or documents requested by any party or upon the hearing officer's own motion.
1. The request shall be in writing and shall state the name and address of the witness and the nature of the expected testimony. The nature of the witness' testimony must be relevant to the issues of the hearing; otherwise the hearing officer may deny the request.2. A request for subpoena of documents shall describe them in detail and provide the name and address of the custodian.3. The request for the issuance of a subpoena shall be filed a minimum of five working days before the hearing.4. The Department shall prepare and serve all subpoenas. Service of the subpoena shall be accomplished by certified mail, return receipt requested.Ariz. Admin. Code § R6-8-112
