Section R3-3-1009 - Failure to Abate
A. The Director shall include in a citation for an alleged violation of this Article a reasonable time to abate the violation.B. When a cited person timely files a request for hearing to contest a violation, the abatement period does not begin to run until the entry of a final order as long as the request for hearing was initiated in good faith and not solely for delay or avoidance of penalties. If a person contests only the amount of the proposed penalty, the person shall correct the violation within the originally prescribed abatement period.C. If the Director has reason to believe the cited person has failed to correct the violation within the abatement period, the Di-rector shall notify the person by mail of the failure, the proposed penalty, and the right to request a hearing.D. On a showing by a cited person of a good faith effort to comply with the abatement requirements of a citation and that the abatement has not been completed because of factors beyond the person's reasonable control, the Department shall issue an order affirming or modifying the abatement requirements in the citation after an opportunity for a hearing.Ariz.
